Last Updated: April 2026

Heading

Description

Introduction

  • Last updated: April 2026.
  • TP is committed to respecting your privacy.
  • This privacy notice describes how TP group companies you are dealing with (“TP”, “we”, “us”, “our”) handle your personal information in connection with the use of Hallo.ai, an AI-powered language and skills assessment platform, for the purpose of assessing candidates applying for a job at TP. This notice tells you what personal information is collected, why it is processed, how it is protected, and what rights you have.
  • We have implemented a global program, based on our Binding Corporate Rules, which functions as our code of conduct for privacy across our business, so we can responsibly process personal information.
  • Our privacy practices may vary among the countries in which we operate to reflect local practices and legal requirements.
  • This privacy notice applies where TP acts as a ‘controller’ of your personal information. Hallo, Inc. acts as a data processor on our behalf.
  • If you do not agree with the terms of this privacy notice, please contact us before proceeding with the assessment.

Who We Are (Data Controller)

The data controller responsible for the processing of your personal information is:

TP SE

21, Rue Balzac, 75008 Paris, France

Email: privacy@TP.com

The relevant local TP entity in your country of application may be a joint controller or separate controller.

About Hallo.ai (Data Processor)

We use Hallo, Inc. (“Hallo.ai”), a third-party service provider based in the United States, whose platform provides AI-powered language and skills assessments. Hallo.ai processes your personal information solely on our instructions and in accordance with a Data Processing Agreement (DPA) we have entered into with them, in compliance with Article 28 GDPR. Hallo.ai is ISO/IEC 27001 certified and has undergone a SOC 2 Type II examination.

Hallo, Inc. may engage sub-processors in the performance of its services to us, including cloud infrastructure and AI service providers. Hallo, Inc. is contractually required to ensure that any sub-processors it appoints provide equivalent data protection guarantees. Transfers to any such sub-processors are subject to appropriate safeguards in accordance with Chapter V GDPR.

Purpose of Processing & Legal Basis

We process your personal information for the following purpose:

Purpose: Assessing candidates applying for a job at TP, including evaluating language proficiency, communication skills, and other role-relevant competencies through the Hallo.ai platform.

Legal bases (Article 6 GDPR):

We rely on the following legal bases for the processing described in this notice:

  • Assessment administration (name, contact details, assessment responses, AI-generated scores): Article 6(1)(b) GDPR — processing is necessary to take pre-contractual steps at your request in connection with your job application.
  • Proctoring data (audio/video/screenshots during assessment): Where an assessment session is proctored, we collect audio and/or video recordings, screenshots, and related technical data for the purpose of ensuring assessment integrity. We rely on Article 6(1)(f) – our legitimate interest in maintaining a fair assessment process – as the legal basis for this processing. We have assessed that our legitimate interests is proportionate.
  • Legal claims and compliance: Article 6(1)(c) GDPR — processing is necessary to comply with a legal obligation.

Where we rely on our legitimate interests as a legal basis (Article 6(1)(f) GDPR), those interests are: selecting suitably qualified candidates efficiently, ensuring the quality and consistency of our hiring process, and reducing bias through structured assessment. We have assessed that these interests are not overridden by your rights and freedoms, having regard to: the limited categories of data collected; the direct relevance of the assessment to the role applied for; the fact that candidates are informed in advance; and the safeguards in place, including mandatory human review of all AI-generated outputs. You have the right to object to this processing at any time — see ‘Your Rights’ below.

Where required under applicable local law, we may also rely on your explicit consent. You have the right to withdraw your consent at any time without affecting the lawfulness of prior processing.

Automated decision-making:

The Hallo.ai platform generates AI-produced scores and analytics which are provided to TP recruiters as one input among several in evaluating your application. No decision to exclude or advance a candidate is made solely on the basis of an automated score. A TP recruiter reviews all results before any outcome is communicated.

To the extent that AI-generated outputs constitute or contribute to profiling with legal or similarly significant effects, you have the right under Article 22 GDPR to: request human review of the assessment outcome; express your point of view; and contest any decision. To exercise these rights, please contact us at privacy@TP.com.

Personal Information We Collect

In the context of the Hallo.ai assessment, TP (or Hallo.ai on our behalf) may collect the following categories of personal information:

Information you provide directly:

  • Basic contact details: name, email address.
  • Registration data: account username and related credentials created for the assessment.
  • Language and skills assessment responses: spoken audio recordings, written responses, reading and listening task results, role-play simulation recordings.

Information collected automatically or through proctoring:

  • Device information: device type, operating system, browser type, IP address.
  • Usage data: date and time stamps, access logs, interactions with the assessment platform.
  • Proctoring data: where the assessment is proctored: screenshots, still images, audio and/or video recordings during the assessment session, for the purpose of ensuring the integrity and validity of the assessment. Proctoring data is collected solely for assessment integrity, fraud prevention, and quality assurance purposes.

Assessment outputs:

  • We also generate derived data about you in the form of AI-produced scores and assessments. These are produced by Hallo.ai’s platform on the basis of the responses and recordings you provide. They do not constitute a separate source of data collection but are analytical outputs created from your direct submissions.

Provision of this personal information is a condition of participating in the assessment. If you do not provide the requested information, you may be unable to complete the assessment, which may affect the progress of your application.

Cookies and similar technologies:

  • The Hallo.ai platform may use cookies and similar tracking technologies to enable platform functionality, ensure security, and analyse usage. Strictly necessary cookies are deployed without requiring your consent as they are essential to the operation of the platform. Where other cookies are used, Hallo.ai will seek your prior consent via a cookie management tool before placing them.

We use your personal information to:

  • Conduct and administer the language and skills assessment via the Hallo.ai platform.

  • Ensure assessment integrity through proctoring measures where applicable.
  • Comply with our legal and regulatory obligations.
  • Administer our recruitment process and maintain related records.
  • Defend or exercise legal claims where necessary.

We will not use your assessment data for marketing, advertising, or any purpose unrelated to the recruitment process without your separate, explicit consent.

How We Share Your Personal Information

We may share your personal information with the following parties:

  • Hallo, Inc. (Data Processor): as the platform provider processing data on our behalf under a Data Processing Agreement.

International Data Transfers

As TP operates globally and Hallo.ai is based in the United States, your personal information may be transferred to, accessed from, or stored in countries outside the European Economic Area (EEA) that may not provide an equivalent level of data protection.

We ensure that such transfers are subject to appropriate safeguards, including:

  • Binding Corporate Rules (BCRs): Transfers of your personal information among TP group entities are governed by TP’s Binding Corporate Rules (BCRs), approved by EU data protection authorities. Our BCRs set out binding obligations on all TP group entities regarding the protection of personal information and grant you enforceable rights as a third-party beneficiary.

  • Standard Contractual Clauses (SCCs): For transfers of your personal information to Hallo, Inc. in the United States, we rely on the European Commission’s Standard Contractual Clauses as the transfer mechanism under Article 46(2)(c) GDPR.  Prior to transferring data, we have conducted a Transfer Impact Assessment and we are satisfied that your personal data will receive a level of protection essentially equivalent to that guaranteed within the EEA.

How We Protect Your Personal Information

We use appropriate technical and organisational security measures to protect your personal information against unauthorised access, loss, or misuse. These measures include:

  • Encryption of data in transit and at rest.
  • Access controls limiting who can access assessment data.
  • Hallo.ai’s ISO/IEC 27001 certification and SOC 2 Type II controls.
  • Contractual obligations on Hallo.ai to maintain equivalent security standards.

No transmission or storage system can be guaranteed to be completely secure. If you have reason to believe that your interaction with us is no longer secure, please contact us immediately at privacy@TP.com.

How We Retain Your Personal Information

We retain your personal information only for as long as necessary to fulfil the purposes described in this notice, including:

  • For the duration of your recruitment process with TP.
  • For a period thereafter to handle queries, disputes, or legal claims arising from the process.
  • Proctoring recordings are deleted at the end of the recruitment process, unless retention is required to investigate a specific integrity concern, in which case they will be retained only for the duration of that investigation. Where local law requires a different retention period, the applicable local period will apply.
  • Should you be unsuccessful, the other data related to your application will be kept for one year.

When we no longer need your personal information, we implement processes to securely delete or anonymise it. Aggregated, anonymised data may be retained and used by Hallo.ai for lawful business and research purposes without being able to identify you.

As a data subject under the GDPR, you have the following rights in relation to your personal information:

13. Limitation of Liability and Damages

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW: (A) IN NO EVENT SHALL HALLO OR THE HALLO PARTIES BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF OR INABILITY TO USE THE HALLO SERVICES, THE CONTENT OR THE MATERIALS, INCLUDING WITHOUT LIMITATION ANY DAMAGES CAUSED BY OR RESULTING FROM RELIANCE BY USER ON ANY INFORMATION OBTAINED FROM HALLO, OR THAT RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES OR EMAIL, ERRORS, DEFECTS, VIRUSES, DELAYS IN OPERATION OR TRANSMISSION OR ANY FAILURE OF PERFORMANCE, WHETHER OR NOT RESULTING FROM ACTS OF GOD, COMMUNICATIONS FAILURE, THEFT, DESTRUCTION OR UNAUTHORIZED ACCESS TO HALLO’S RECORDS, PROGRAMS OR SERVICES; AND (B) IN NO EVENT SHALL THE AGGREGATE LIABILITY OF HALLO, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE HALLO SERVICES EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE HALLO SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM OR ONE HUNDRED DOLLARS, WHICHEVER IS GREATER.

HALLO WOULD NOT BE ABLE TO PROVIDE THE HALLO SERVICES TO YOU ON AN ECONOMICALLY REASONABLE BASIS WITHOUT THESE LIMITATIONS.

14. Applicable Law and Venue

(i) To the fullest extent permitted by applicable law, you and Hallo agree that if you are a Subscribing Organization or a consumer resident of a jurisdiction other than those in (ii) below, the following governing law and arbitration provision applies:

PLEASE READ THE FOLLOWING CAREFULLY BECAUSE IT REQUIRES YOU TO ARBITRATE DISPUTES WITH HALLO AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM HALLO.

You and Hallo agree to arbitrate any dispute arising from these Terms of Service or your use of the Hallo Services, except that you and Hallo are not required to arbitrate any dispute in which either party seeks equitable and other relief for the alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets, or patents. ARBITRATION PREVENTS YOU FROM SUING IN COURT OR FROM HAVING A JURY TRIAL. You and Hallo agree that you will notify each other in writing of any dispute within thirty (30) days of when it arises. Notice to Hallo shall be sent to Hallo, Inc. You and Hallo further agree: to attempt informal resolution prior to any demand for arbitration; that any arbitration will occur in Utah County, Utah; that arbitration will be conducted confidentially by a single arbitrator; and that the state or federal courts in Utah County, Utah have exclusive jurisdiction over any appeals of an arbitration award and over any suit between the parties not subject to arbitration. Other than class procedures and remedies discussed below, the arbitrator has the authority to grant any remedy that would otherwise be available in court. Any dispute between the parties will be governed by this Agreement and the laws of the State of Utah and applicable United States law, without giving effect to any conflict of laws principles that may provide for the application of the law of another jurisdiction. Whether the dispute is heard in arbitration or in court, you and Hallo will not commence against the other class action, class arbitration or other representative action or proceeding.

(ii)     If you are a resident in any jurisdiction in which the provision in the section above is found to be unenforceable, then the following shall apply:

Any disputes, claims or causes of action arising out of or in connection with these Terms of Service will be governed by and construed under the laws of the jurisdiction of your residence.

15. Claims

YOU AND HALLO AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE HALLO SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

16. Miscellaneous

If we fail to exercise or enforce any right or provision of these Terms of Service, it will not constitute a waiver of such right or provision. Any waiver of any provision of these Terms of Service will be effective only if in writing and signed by the relevant party.

If any provision of these Terms of Service or any Guidelines is held to be unlawful, void, or for any reason unenforceable, then that provision will be limited or eliminated from these Terms of Service to the minimum extent necessary and will not affect the validity and enforceability of any remaining provisions.

These Terms of Service and related Guidelines, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Hallo without restriction. Any assignment attempted to be made in violation of this Terms of Service shall be void.

Upon termination of these Terms of Service, any provision which, by its nature or express terms should survive, will survive such termination or expiration, including, but not limited to the Sections above.

17. Entire Agreement

The Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and Hallo relating to the subject matter herein and will not be modified except in writing, signed or otherwise agreed to by both parties, or by a change to these Terms of Service made by Hallo as set forth in the Sections above.
